ARTICLE 1 – PURPOSE

These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) govern the contractual relationship between EMMA GROUP (LUMA Reformer), a SASU registered under number 944 480 805, whose registered office is located at 85 bis rue de Marolles, 94470 Boissy-Saint-Léger, and any natural or legal person wishing to make a purchase on the website www.lumareformer.com.
By confirming an order, the customer acknowledges having read, understood, and unreservedly accepted these GTC.

ARTICLE 2 – PRODUCTS

LUMA Reformer offers for online sale Pilates equipment (including foldable models) and complementary accessories, intended for professionals (studios, coaches, physiotherapists, etc.) as well as private customers.
Images and descriptions are provided for illustrative purposes only. Despite our vigilance, slight variations may exist between production batches. This does not affect the conformity of the delivered product.

ARTICLE 3 – PRICES

Prices are indicated in euros, all taxes included (TTC), excluding any applicable processing and delivery fees.
The VAT applicable will be invoiced at the legal rate in force at the time of billing.
LUMA Reformer reserves the right to modify its prices at any time, without notice, but products will be invoiced based on the rates in effect at the time the order is placed.

ARTICLE 4 – ORDER AND PAYMENT

The order is confirmed upon receipt of payment through one of the following methods:

Credit card (Visa, Mastercard)

PayPal (4x interest-free payment)

Bank transfer

For payments in two instalments, a minimum deposit of 40% of the total amount including VAT is required to confirm the order, followed by the remaining balance due on the day of shipment, upon issuance of the final invoice.

The Client commits to providing accurate information when placing an order. Any error resulting in delay or non-delivery shall not engage the responsibility of LUMA Reformer (EMMA GROUP).
LUMA Reformer reserves the right to refuse or cancel any suspicious or fraudulent order.

ARTICLE 5 – DELIVERY

Delivery zones in Europe: France, Belgium, Luxembourg, Germany, Spain, Portugal, Italy, United Kingdom, Netherlands, Austria, Poland, Greece, Czech Republic, Lithuania, Estonia, Denmark, Switzerland, etc.

The preferred delivery method is DDP (Delivered Duty Paid), meaning we cover import taxes and any customs fees.

For certain specific destinations such as the United Kingdom or Switzerland (non-exhaustive list), delivery may be carried out under DAP – Delivered At Place, which results in VAT and any applicable customs fees being paid by the Client.

International delivery zones: North America, Asia, Middle East, Australia, New Zealand.

Estimated delivery times:

Europe: 7 to 9 weeks

Other listed regions: 8 to 10 weeks

The delivery times communicated by LUMA Reformer (EMMA GROUP) are provided for informational and indicative purposes only. They do not constitute a binding commitment or strict deadline.
LUMA Reformer (EMMA GROUP) shall not be held liable for any delivery delay.

Consequently, any delay shall not entitle the Client to penalties, compensation, damages, cancellation, or termination of the order.

LUMA Reformer (EMMA GROUP) shall not be held liable for indirect, immaterial, or consequential damages resulting from delivery delay, including but not limited to: loss of revenue, operational loss, commercial prejudice, or loss of clientele.

LUMA Reformer (EMMA GROUP) shall not be held liable for any delay due to force majeure, third-party events (carrier, customs), or any circumstance beyond its reasonable control.

5.1 Incoterm and Delivery Location

Delivery is made under DDP (Delivered Duty Paid) to the address provided by the Client at street level (no door-to-door installation), with unloading but without setup.
Transport and insurance costs are the responsibility of the seller unless otherwise agreed in writing.

If delivery at the designated location is impossible (traffic restrictions, vehicle size limitations, etc.), LUMA Reformer (EMMA GROUP) may charge additional fees for delivery rearrangement upon simple request.

For deliveries to Switzerland, the United Kingdom, and non-EU destinations, deliveries may be made under DAP (Delivery At Place). Please contact us at contact@lumareformer.com to arrange delivery.

ARTICLE 6 – DELIVERY CLAIMS

Parcel marked as delivered but not received:
The Client must immediately contact the carrier using the tracking number.
LUMA Reformer will initiate a complementary inquiry if the parcel is considered missing.
Without a claim within 30 days following shipment, the order is considered delivered.

Address error:
Any modification must be notified within 24h of placing the order.
In case of incorrect address provided by the Client, LUMA Reformer shall not be held liable for misdelivery or parcel loss.

ARTICLE 7 – RIGHT OF WITHDRAWAL AND RETURNS

In accordance with consumer law, the Client has a 14-day withdrawal period from the date of receipt.
LUMA Reformer grants a 30-day return period for its machines.

Conditions:

Product unused, in perfect condition, in its original packaging

Return shipping costs borne by the Client

Return mandatory after contacting customer service: contact@lumareformer.com

Failure to meet these conditions may result in a 25% deduction from the refund

Customs duties and VAT paid at delivery are non-refundable.

7.1 Exclusions

The right of withdrawal does not apply to custom-made or personalized products (upholstery, specific colors, logo engraving, etc.).

ARTICLE 8 – DAMAGED / NON-CONFORMING PRODUCTS

The Client must check the condition and quantity of the goods upon delivery, in the presence of the carrier.
Any anomaly (visible damage, missing or non-conforming product) must be noted on the delivery slip and confirmed by email (contact@lumareformer.com) within 48 hours, with photos.
Without such report, the merchandise is deemed accepted without reservation.

Deductions may apply if the product shows signs of wear or has been used.

ARTICLE 9 – LIABILITY

LUMA Reformer shall not be held liable for any indirect damage, loss of data, loss of profits, or service interruption resulting from use of the site or products, or from inability to use them.

ARTICLE 10 – PERSONAL DATA

Data collected is used for order management, customer communication, and service improvement.

In accordance with GDPR, the Client may request access, rectification, or deletion of their data by emailing: contact@lumareformer.com.

ARTICLE 11 – APPLICABLE LAW

These GTC are subject to French law.
In case of dispute, an attempt at amicable resolution will be favored before any legal action.
